How it Works

Once we receive your order and your card is processed successfully you will receive an email confirmation which will include

  1. The products you have purchased
  2. The price of each product and the total amount debited to your card
  3. Your receipt number
  4. Your delivery address details

Your order will be dispatched on the same (business) day if placed before 12pm (AEST). If placed after 12pm or on weekend, your order will be dispatched the following business day. When your order is posted you will receive a further notification that the goods have been shipped.

Trading Terms and Conditions
For Sale of Goods

1. Interpretation

In these trading terms and conditions (“Terms”) unless the contrary intention appears:

Additional Charges” includes all delivery, handling and storage charges, goods and services tax, stamp duty, interest, legal and other costs of recovery of unpaid money and all other government imposts and all money, other than the Purchase Price, payable by the Customer to Caruso’s arising out of the sale of the Goods.

Customer” means the person to or for whom the Goods are to be supplied by Caruso’s.

Goods” means the goods sold to the Customer by Caruso’s

“Caruso’s” means Caruso’s Natural Health Pty Limited, ABN 16 002 029 227of 14 Shale Place, Eastern Creek NSW 2766

Purchase Price” means the price for the goods as charged by Caruso’s at the date of delivery or such other price as may be agreed by Caruso’s and the Customer prior to delivery of the Goods.

2. Order for Goods

2.1 An order given to Caruso’s is binding on Caruso’s and the Customer, if:

2.1.1 a written acceptance is signed for or on behalf of Caruso’s; or

2.1.2 the Goods are supplied by Caruso’s in accordance with the order.

2.2 An acceptance of the order by Caruso’s is then to be an acceptance of these Terms by Caruso’s and the Customer and these Terms will override any conditions contained in the Customer’s order. Caruso’s reserves the right to accept a part only of any order by notifying the Customer in writing or by delivering the Goods to the Customer. No order is binding on Caruso’s until accepted by it.

2.3 An order which has been accepted in whole or in part by Caruso’s cannot be cancelled by the Customer without obtaining the prior written approval of Caruso’s, which it may refuse in its absolute discretion.

3. Warranties

3.1 Caruso’s liability is limited to, to the extent permissible by law and at Caruso’s option;

3.1.1 in relation to the Goods:

  1. the replacement of the products or the supply of equivalent products
  2. the repair of the products

iii. the payment of the cost of replacing the products or of acquiring equivalent products; or

  1. The payment of the cost of having the products repaired

3.1.2 Where the Goods are services:

  1.  the supply of service again; or
  2.  the payment of the cost of having the services supplied again.

3.2 Any claims to be made against Caruso’s for short delivery of Goods must be lodged with Caruso’s in writing within 48 hours of the delivery date.

3.3 To the extent permitted at law, all other warranties whether implied or otherwise, not set out in these Terms are excluded and Caruso’s is not liable in contract, tort (including, without limitation, negligence or breach of statutory duty) or otherwise to compensate Customer for:

3.3.1 any increased costs or expenses;

3.3.2 any loss of profit, revenue, business, contracts or anticipated savings;

3.3.3 any loss or expense resulting from a claim by a third party; or

3.3.4 any special, indirect or consequential loss or damage of any nature whatsoever caused by Caruso’s failure to complete or delay in completing the order to deliver the Goods.

4. Delivery

4.1 The times quoted for delivery are estimates only and Caruso’s accepts no liability for failure or delay in delivery of Goods. The Customer is not relieved of any obligation to accept or pay for Goods by reason of any delay in delivery. Goods may be delivered by instalments at the discretion of Caruso’s.

4.2 Risk in accepting the Goods passes on delivery to the Customer.

4.3. All Additional Charges are payable by the Customer in addition to the Purchase Price of the Goods.

4.4. Return of Goods will not be accepted by Caruso’s except by prior agreement in writing with Caruso’s. .

5. Price and Payment

5.1 The Customer must pay the Purchase Price and the Additional Charges to Caruso’s.

5.2 If the Customer is in default, Caruso’s may at its option withhold further deliveries or cancel a contract without prejudice to any of its existing rights.

5.3 All amounts payable by the Customer under these Terms must be paid without set-off or counter claim of any kind.

6. Retention of Title

6.1 Ownership, title and property of the Goods remains with Caruso’s until payment in full for the Goods and all sums due and owing by the Customer to Caruso’s on any account has been made.

7. Indemnity

To the full extent permitted by law, Customer will indemnify Caruso’s and keep Caruso’s indemnified from and against any liability and any loss or damage Caruso’s may sustain, as a result of any breach, act or omission, arising directly or indirectly from or in connection with any breach of any of these Terms by Customer or its representatives.

8. General

8.1 These terms and conditions are to be construed in accordance with the laws from time to time in the State of New South Wales and the Commonwealth of Australia.

8.2 These standard trading conditions contain all of the terms and conditions of the contract between the parties and may only be varied by agreement in writing between the parties.

8.3 Any conditions found to be void, unenforceable or illegal may, to that extent be severed from the Agreement.

8.4 No waiver of any of these terms and conditions or failure to exercise a right or remedy by Caruso’s will be considered to imply or constitute a further waiver by Caruso’s of the same or any other term, condition, right or remedy.


Refund Policy

Claims for refunds for damaged goods must be made within 48 hours of receipt of the goods. Contact customerservice@carusoshealth.com.au

Delivery

Orders will be posted to the “Delivery Address” on the order and will be processed within 3 working days of receipt of the order.

Shipping Charges:
The cost of shipping will be calculated at the time of your purchase through carusoshealth.com.au and you will be able to view this in your cart before proceeding.

Address Details:
Please ensure that you enter the correct address details when making your purchase, and that you include the company name and person receiving the order (if being delivered to a business). Caruso’s Natural Health does not take responsibility for failure of delivery due to incorrect address details or company name not being included.

Returned Parcels:
Should your parcel be returned due to incorrect details being provided or the parcel not being collected, you will have the option to have the parcel resent. Standard shipping costs will apply to resending of the parcel. Should you wish to instead receive a refund, Caruso’s Natural Health will assess the parcel to ensure no damage has taken place and if so provide you with a refund.

Damaged Goods:
If your parcel and goods have been damaged in transit, we will ask for proof of such before establishing whether a refund or exchange will take place. Please contact us to discuss.

Customs and Taxes:
It is the customer's responsibility to ensure that what they order (and the quantity) is not restricted in their destination country. Caruso’s Natural Health does not take responsibilty for the actions of customs in any destination country. If a parcel is seized due to restricted items or for tax purposes, it is the customer's responsibility to be in contact with their customs office and resolve the issue. If a parcel is returned to Caruso’s Natural Health due to a customs seizure, a return fee will be charged to the customer. This return fee will be the same cost that you initially paid for the shipping of your order. Customers who wish to have their parcel re-sent to them, will need to pay a re-postage fee (on top of the return fee). If the customer does not want the parcel resent, the option of a credit or exchange will be offered. However, to receive a credit or exchange, the products returned must be received unopened, undamaged. The exchange or credit value will be for the cost of the product(s) only, less the return shipping fee.

Heat Sensitive Products:
Caruso’s Natural Health sends a free cool pack with Heat Sensitive products. Please be advised we do not use a refrigerated delivery service.
